Guardianship:
Prentice was apointed guardian for the children of Margaret L. Davis and himself - Sarah Ann and James M. Davis - by the County Court of Blount County on Jan 05, 1862, as they had some interest in an estate or some property in NC. Daniel Headrick and J. M. Davis being sureties on a $3000 bond Jan 05, 1863, and G. M. Wells and W. W. Lawrence on a $1500 bond on Mar 06, 1869. Prentice filed his account, which was cleared, Sept 27, 1871. It showed that he ahad paid out more than he had received ($335) and was owed $263 by the heirs. The Clerk of the Court reported:

"It will be seen also that I have allowed said guardian for his service the sum of two hunderd and fifty dollars, which seems at first view to be rather high, but when we take into consideration the great touble and expense he has been at in travelling from here to North Carolina and back, trying to collect the money which he says caused him to make ten trips and about two weeks at a trip, paying his won expenses, it will be seen that the amount is not so exhorbitant."

In his account Prentice said, "But there is a probablility of something more coming to said heirs, and if this should happen, I will report the same to the Court." Probably for this reason Sam P. Rowan, R. N. Hood and W. D. McGinley became suretires on another bond for $600 on Oct 02, 1871. No further filings were found. (Blount County Court Records, book 10, p. 387 et seq.)

Prentice undoubtedly had in mind the estate of the wife's father John W. Davis whose undated Will was probated Oct 7, 1862 and required that all testator's personal and real property be sold and the proceeds divided among his eight children (or their children) and his widow on a share and share alike basis. The Will specifically referred to "the children of Margaret Davis who intermaried P. L. Davis." No accounting has been found to show the actual distribution or distributions made for account of children Sarah Ann and James Murphy Davis.
